1. Acceptance of Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you and TNAADO Inc. (“Company,” “we,” “us”) governing your access to and use of GEB — Gesture Beats, including the mobile application, website (gesturebeats.app), and all related services (collectively, the “Service”).
You must be at least 13 years of age to use GEB. By using the Service, you represent that you meet this age requirement.
2. Description of Service
GEB is an AI-powered iOS application that enables users to create music and beats through body gesture recognition via the device camera. The Service includes Studio Mode (gesture-controlled beat creation), Live Play Mode (AI-reactive music), and related features.
GEB is currently in beta. Features, pricing, and functionality may change without notice during this period.
3. Account Registration
Certain features require account creation. You agree to:
- Provide accurate and complete registration information
- Keep your login credentials confidential
- Notify us immediately of any unauthorized account access at contact@tnaado.ca
- Be responsible for all activity that occurs under your account
We reserve the right to terminate accounts that violate these Terms or are inactive for extended periods.
4. Subscriptions, Credits, and Payments
4.1 Subscription Plans
GEB offers the following subscription plans that provide access to premium features and periodic Credit allocations:
- Weekly Plan: $1.49 USD per week, billed automatically each week
- Monthly Plan: $4.99 USD per month, billed automatically each month
4.2 Free Trial
New subscribers may be eligible for a free trial period of seven (7) days. During the free trial, you will have access to the full premium features at no charge. At the end of the trial, your subscription will automatically convert to a paid subscription at the applicable rate unless you cancel before the trial period ends. You may cancel at any time through your Apple ID account settings.
4.3 Auto-Renewal
All subscriptions automatically renew at the end of each billing period unless you cancel at least twenty-four (24) hours before the end of the current period. Your Apple ID account will be charged for renewal within twenty-four (24) hours prior to the end of the current period. You may manage your subscription and turn off auto-renewal at any time in your Apple ID account settings.
4.4 In-App Credits
Certain GEB features require in-app credits (“Credits”). Credits are consumable digital items with no monetary value outside the Application. Credits are non-refundable once consumed, cannot be exchanged for cash, and cannot be transferred to another user or account. Each use of a credit-based feature deducts the applicable number of Credits from your balance.
4.5 Payment Processing
All payments are processed through the Apple App Store and by Stripe Inc. By making a purchase, you agree to the applicable payment processor’s terms. TNAADO Inc. does not store your payment card information.
4.6 Refunds
In-app purchases and subscriptions are processed through Apple and are subject to Apple’s refund policies. To request a refund, contact Apple directly through their standard refund process. Consumed Credits are non-refundable under any circumstances. TNAADO Inc. does not process refunds for purchases made through the Apple App Store.
5. Acceptable Use
You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of GEB
- Use GEB to create content that is illegal, harmful, defamatory, or violates third-party rights
- Attempt to circumvent security measures or access restricted systems
- Use automated scripts, bots, or scraping tools on the Service
- Impersonate any person or entity
- Violate any applicable local, national, or international law
6. Intellectual Property
6.1 Our Property
GEB, the GEB logo, all underlying technology, AI models, software, and content created by TNAADO Inc. are owned by or licensed to TNAADO Inc. and protected by intellectual property laws.
6.2 Your Content
You retain ownership of music and beats you create using GEB. By using the Service, you grant TNAADO Inc. a limited, non-exclusive license to process your content solely to provide the Service.
6.3 Feedback
Any feedback, suggestions, or ideas you provide regarding GEB may be used by TNAADO Inc. without restriction or compensation.
7. Camera & Device Permissions
GEB requires camera access for gesture detection. All camera processing occurs on-device. By granting camera permission, you acknowledge this use. You can revoke permissions at any time through your device settings, though this will affect app functionality.
8. Disclaimers
GEB is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
9. Limitation of Liability
To the maximum extent permitted by law, TNAADO Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of GEB. Our total liability to you for any claim shall not exceed the amount you paid to TNAADO Inc. in the 12 months preceding the claim.
10. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Toronto, Ontario, Canada.
11. Changes to Terms
We may update these Terms at any time. We will notify registered users of material changes via email. Continued use of the Service after changes constitutes acceptance.
